In October 1952, while Monroe was duly challenging his discharge through the appropriate administrative channels, this court upheld the constitutionality of the Levering Oath in the case of Pockman v. Leonard (1952) 39 Cal.2d 676 [249 P.2d 267]. Thereafter the State Personnel Board sustained Monroe's dismissal on September 11, 1953.
